Law Enforcement, Traffic ViolationsAbstract
Law enforcement for traffic violators through Electronic Traffic Law Enforcement (ETLE) Directorate of the Metro Jaya Police. Law enforcement against ETLE violators also has a legal basis, namely article 272 of the UULAJ, which is related to the enforcement of traffic and road transportation violations using electronic equipment. Although the two legal references specifically do not mention electronic tickets, basically the application of legal sanctions to ETLE violators has met the mechanism for action. Meanwhile, regarding evidence in law enforcement, ETLE has been covered in article 5 of the ITE Law which states that printed materials from electronic information and/or electronic documents are valid evidence. The output of ETLE in the form of photos and videos of violations can be positioned as evidence of clues and this also fulfills the provisions that regulate legal evidence as stipulated in article 184 of the Speech Code The Criminal Law (KUHP) is in the form of witness statements, experts, defendants, letters and instructions. So that with the legal basis mentioned above, there are no more problems related to the ETLE law enforcement factor. The procedure and mechanism for fines in the electronic ticketing system, namely ETLE cameras installed on the road, automatically capture traffic violations committed by motorists. Then, vehicle data will be sent to the ETLE back office at the RTMC Polda Metro Jaya. Later, officers will identify vehicle data using electronic registration & identification (ERI) as a source of vehicle data.
